RealWebco.com does not sell, trade or otherwise distribute, customer information, email addresses or any other customer data to anyone.

30 Day Risk Free Trial (Refund Policy):

If you are unhappy because you did receive what we have promised to deliver you can terminate hosting and will be refunded your payment for hosting services. We do not refund fees for domain name registration. You registered the name and you own it. You must pay for it.

After the initial 30 day period, if you have paid annually for web hosting, we will refund the balance remaining on your account at the time of your termination of hosting services. All hosting is paid for the month in advance and we cannot refund partial months. Example: If your paid for 1 year and your hosting commenced on 1/15 and you then decide to terminate hosting on 4/22, you will be refunded the balance from 5/15 to 12/15. There is no refund on month to month payments since all hosting is paid in advance and we can't refund partial months.

We provide web hosting for many clients, and we have a responsibility to protect each client and provide the best services available. The following guidelines have been designed to protect and serve each of our clients.

Content:

All services obtained from RealWebCo may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States, Federal, State, County or City law is prohibited. This includes, but is not limited to copyrighted material, material RealWebCo judges to be threatening, obscene, demeaning to others or material protected by trade secret or other statute. The Subscriber agrees to indemnify and hold RealWebCo and its affiliates harmless for any claims resulting from the use of the service.

Pornography and sex related merchandising are prohibited on all servers. This includes sites that may infer sexual content or link to adult content elsewhere.

Sites promoting any illegal activity are prohibited. Sites with content that may damage our servers or any other servers on the internet are prohibited. Sites providing links to any such sites are also prohibited.

Sites selling or promoting bulk email services are prohibited.

Sites with content or links involving pirated software, Hackers programs and/or Hackers archives, Warez Sites, Irc Bots and illegally distributed Mp3 are prohibited.

The foregoing is not a complete list of prohibited content, links or activities. The bottom line; If it is illegal or judged to be patently offensive or obscene we don't want it our servers.

RealWebCo is the party that will make the decision as to whether any material submitted violates the foregoing or any other policies of RealWebCo.

CGI Scripts:

Each account comes with its own cgi-bin. You may use any CGI scripts you wish, however we reserve the right to disable, without prior notice, any CGI script that effects the normal operation of our servers.

Chat Rooms:

Subscribers may not install their own chat rooms. Chat rooms tend to be system hogs that affect the performance of our system and ability to serve all subscribers. We do provide the alternative of Java chat rooms for a small extra charge that should adequately meet your needs.

Background Running Programs:

Background daemons, in general, are prohibited. We will consider individual requests. If allowed, extra charges will be assessed based on resources.

IRC:

We currently do not allow IRC or IRC Bots to be operated on our servers.

Commercial Advertising - Email Spam:

Our servers may not be the source, intermediary or destination address involved in the transmission of spam, flames or mail bombs. Your domain may not be referenced as originator, intermediary or reply-to address for any of the above. Advertising sites on other servers which, in turn, contain links to a domain on our servers is prohibited. We consider spam to be any mass, unsolicited, message disseminated through Newsgroups or Email. If it is determined by RealWebCo that a subscriber is spamming, RealWebCo reserves the right to, without warning, disable subscribers domain and discontinue service without refund of any prepaid amounts. In addition, RealWebCo reserves the right to impose a penalty of $100.00 for each spam policy violation. RealWebCo reserves the right to refuse and or cancel service to know spammers.

Server Abuse:

Subscriber shall not affect or attempt to affect, in any way, the operation of RealWebCo servers or the RealWebCo system.

Indemnification Agreement:

Subscriber agrees that it shall defend, indemnify, save and hold RealWebCo harmless for any and all demands, liabilities, losses, costs, claims and judgments, including reasonable attorneys fees asserted against and/or incurred by RealWebCo, its agents, customers, officers, shareholders, employees and insurers, that may arise out of or result from any service provided, performed or agreed to be performed or any product sold by subscriber, it's agents employees or assigns.

Refusal of Service:

RealWebCo reserves the right to refuse or cancel service.

Disclaimer:

RealWebCo is not responsible for any damages incurred by subscriber. RealWebCo makes no warranties, of any kind, express or implied as to the service it provides. RealWebCo disclaims any warranty of merchantability and/or fitness for a particular purpose. This includes, but is not limited to, loss of data resulting from delays and any and all service interruptions.

Payment:

Where payment is made by check, the site will not be activated until the check has been received by RealWebCo and confirmation is received from the bank that the check is good. In the event payment for hosting services is made by check, the initial payment shall be for (3) three months service plus the set-up fee. Thereafter billing for check payment accounts will be made quarterly. If payment is not received within 15 days of the billing date the site will be deactivated and not reactivated until payment has been received and funds have been confirmed by the bank.

Due date for any account will vary depending on the date of site activation. If payment is not received by the due date of any invoice the site will be deactivated.

Customer agrees to pay all costs of collection, including reasonable attorney fees, if collection action is necessary.

RealWebCo reserves the right to change or update these policies without notice.

Violation of any of these policies may result in deactivation of your account without refund of any prepaid funds.
